Worker's Compensation Benefits Explained

Worker's Compensation cases are governed by the Illinois Worker's Compensation Act.

If you are injured at work, you do not have to prove negligence by anyone. It is essentially a strict liability statute as long as you are, in fact, an employee and were provably injured at work. This is why reporting your injury promptly to a supervisor is crucial.

There are three benefits that exist for a worker injured at work:

  • Medical expenses stemming from the injury and needed to recover
  • Temporary Total Disability (TTD) benefits/pay - this replaces your pay while you are still in active treatment.
  • Permanent Total Disability (PTD) payment - this is a lump sum payment at the conclusion of the case that compensates for the loss of the body part.

Worker's Compensation cases are handled in the IWCC (Illinois Worker's Compensation Commission). You should be represented by an attorney who regularly practices in the IWCC and is well-versed in the law of Worker's Compensation.
